East West to Continue With High Court Appeal Against the Two Airline Policy:

East West is to continue with its challenge to the TAP despite the release of the May Enquiry and a general consensus that the system will ultimately be changed in its favour.

EWA launched their historic challenge to Section 92 of the Constitution, which relates directly to free trade between the States, back in December of 1985. Since then the High Court has been taxed with its own internal problems following the dismissal of Mr Justice Murphy only days after East-West lodged their challenge. As a full bench was required to pre-side on such important matters of law then the case literally went nowhere while the Murphy affair dragged on through most of last year.
