Court Finds Afap Guilty of Having Deliberately Caused Loss to Airlines:

The AFAP could be liable for up to $10m in damages following the landmark decision in late November by Justice Broking in the Victorian Supreme Court.

The decision was one of the first common law actions brought against a union by an employer group and made industrial relations history as it represented the first instance of a union being held specifically accountable for its actions against an employer when the due courses of Arbitration were not used. The decision rocked the union movement as it essentially nullified the worker’s right to strike and for a brief time put the ACTU in a situation of offering technical support to the AFAP.
